Alhamdulillaah, as Al Jama-ah we welcome the release of Moulana Farouk Rylands and express gratitude that he is now reunited with his family and community.
Adv Salie has been contacted by several concerned members of the community since the arrest of Moulana Rylands and attended the meeting called at Labour Court Cape Town pending the hearing of and release of our esteemed Moulana
However, this development does not bring closure to the serious concerns that have arisen. It is alleged that Moulana Rylands was arrested and detained in a manner that was procedurally irregular. Such allegations, if substantiated, raise profound questions regarding the adherence to due process, the integrity of law enforcement procedures, and the safeguarding of fundamental rights.
There is a growing need for clarity and accountability on several fronts: who initiated and authorised this arrest, on what legal basis it was executed, and whether all applicable legal and procedural standards were upheld. These are not merely individual concerns but matters that affect public confidence in governance, justice systems, and institutional accountability.
This incident further highlights broader issues within our community relating to governance, the administration of trusts, and the increasing tension between secular legal processes and the application of Deen in matters that directly impact the Muslim community. These concerns require careful, principled engagement rooted in justice, transparency, and unity.
We reiterate the importance of mediation and internal dispute resolution in matters affecting our Ummah. Resorting prematurely to adversarial legal processes often deepens divisions rather than resolving them. As guided by the teachings of Islam, reconciliation and mutual understanding must remain our first recourse wherever possible.
As the Prophet ﷺ said: “The believers, in their love, mercy, and compassion for each other, are like one body; if one limb aches, the whole body responds to it with sleeplessness and fever” (Sahih Muslim 2586).
This moment calls for reflection, accountability, and a recommitment to justice and unity within our community. The matter cannot be regarded as concluded, and we trust that the necessary steps will be taken to ensure transparency and uphold the principles of fairness and due process.
